1. Who you are contracting with

AmtSprache (the "Service") is provided by Fernando Zubero Holdings ("we", "us", "our"). By accessing or using the Service you ("you", the "user") agree to these Terms & Conditions.

2. The Service

AmtSprache provides real-time translation and conversational assistance for German bureaucratic phone calls, including live speech-to-text, translation between German and supported languages, and a call history of your sessions.

3. Eligibility and account

You must be of legal age in your jurisdiction or have authority to bind the organisation you represent. You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your account credentials and for all activity under your account.

The Service uses automated speech recognition and large language models to produce translations. Outputs may be inaccurate, incomplete or out of date. You are responsible for your prompts, for verifying outputs and for ensuring you have the right to any content you input. The Service is not a substitute for qualified legal, immigration, tax or other professional advice. We may filter, refuse or moderate outputs and may suspend accounts that abuse the Service.

6. Intellectual property

We retain all right, title and interest in and to the Service, including all software, documentation, branding and underlying technology. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. Your user content remains yours; you grant us a limited licence to host and process it solely to operate the Service.

7. Plans, payment and Merchant of Record

Paid plans are sold and billed through Paddle. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, subscription renewal, cancellation and refund mechanics are governed by the Paddle Checkout Buyer Terms. Free-tier usage is limited and may be capped or changed at any time.

8. Service level and warranties

We do not warrant that the Service will be uninterrupted, error-free or available at any particular time. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to Paddle for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special or incidental damages, including loss of profits, data or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

10. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your user content, your use of the Service or your breach of these Terms.

11. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your right to use the Service ends; you may request export of your data within a reasonable window before deletion.

12. Changes

We may update these Terms from time to time. Material changes will be notified through the Service.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Fernando Zubero Holdings is established, without regard to conflict-of-laws principles. Disputes will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
